April 24 – US French
Corporation sued Banana King
Distributor LLC under the
Perishable Agricultural
Commodities Act (PACA) for not
paying for green plantains,
betabel beets, scallions,
cilantro and Eastern
potatoes.
On April 22, U.S. District
Court for the Southern
District of New York Judge
Katherine Polk Failla held a
default hearing. Inner City
Press covered it.
Judge
Failla asked about the
attorneys fees.
She said she was
not signing off on $450 an
hour, but did approve the
amount requested, given the
work put in. The plaintiff's
lawyer wanted the filing fee,
but not the cost of serving
the papers.
