FOIA Case Against DOJ By Koch Brother and His Investigator Moved Parallel to FBI Case

SDNY COURTHOUSE, August 2 – William Koch sued the Department of Justice, as well as the Federal Bureau Of Investigation for compliance with the Freedom of Information Act.  He is one of the Koch brothers.

 On August 2, 2022 U.S. District Court for the Southern District of New York Judge Paul A. Engelmayer held a proceeding. Inner City Press covered it.

  A related FBI FOIA request "relates to Bill Koch's decades long efforts to uncover and expose rampant fraud in the international market for rare wines."  This one, to DOJ, "relates to the now-closed prosecution of Rudy Kurniawan."

 Judge Engelmayer asked genially how FOIA exemption might apply to Jencks Act and Rule 16 material, and said to have a good summer, he looks forward to the status reports.

As recounted in the parallel FBI FOIA case, in 2005, Koch discovered four bottles he'd bought were counterfeit. Bradley Goldstein "has overseen Bill Koch's wine investigations since 2006." (Nice work if you can get it). 

 In that case, Judge Rakoff ruled that by June 25 the FBI must propose a discovery schedule; Koch's filing is due the next day, with each side able to reply on July 27.

That case is Koch et al v. Federal Bureau Of Investigation, 22-cv-4421 (Rakoff)

This case is Koch et al v. U.S. Department of Justice, 22-cv-3712 (Engelmayer)
