SDNY COURTHOUSE,
Nov 21 –
Valerie
Dicks, a blind
woman, sued
Oaklandish,
LLC under the
ADA for
allegedly
having an
inaccessible
website.
On November
17, 2022, U.S.
District Court
for the
Southern
District of
New York
Magistrate
Judge James L.
Cott held a
proceeding.
Inner City
Press covered
it.
The
defense lawyer
said he had
gotten an
expert's
report that
there was
nothing
non-compliant
about the
website. Judge
Cott asked
plaintiff's
counsel if
they'd gotten
the report.
Only recently,
was the
answer.
Judge
Cott asked for
a report-back
by December 8
if a
resolution had
been reached.
If not, he
will refer the
matter to the
Court's
Mediation
Program. In
the EDNY, it's
beginning to
be said that
the ADA does
not apply to
websites.
