SDNY COURTHOUSE,
May 27 – In case in
which the US Department of
Justice is considering the
death penalty, Jose Rodriguez
on May 27 with two lawyers
before U.S. District Court for
the Southern District of New
York Judge Alvin K.
Hellerstein. Inner City Press
covered it.
Rodriguez' Learned Counsel
said and co-counsel are
waiting to see if DOJ is going
for execution.
Jose
Rodriguez' indictment was
unsealed in November 2019. It
is for murder of Daquan Cooper
on June 25, 2015 by 1595
Unionport Road in The Bronx.
Dueling drug crews are
referenced.
Now his
defense lawyer said he is not
free for trial until July 27,
2021. Judge
Hellerstein: that's too far
off, in the interest of
justice. He proposed January
11, saying that defense
lawyer's case before Judge
Furman "will have to give."
AUSA Chan said,
This trial's four weeks. It's
a racketeering case "with many
cooperating witnesses."
Judge Hellerstein: We'll do it
in 3 weeks. Judge Furman has
the practice of scheduling his
trials early in the process,
there can always be
settlements. Let's do this one
January 11, 2021.
Defense lawyer:
This is over my
objection. Judge
Hellerstein: How long is the
Furman trial? Defense
lawyer: 6 to 8 weeks, RICO
murder. The activity was in
Puerto Rico. Judge
Hellerstein: I can ask Judge
Furman to put off that trial
for a week.
Defense
lawyer: A lot of effort went
into picking that date. Judge
Hellerstein: If in December
you are in negotiations with
the government about
mitigation, we could adjourn.
I don't set my trial until
people are actually ready, so
we have flexibility.
AUSA Chan
said, We are always in favor
of a speedy trial. But the
Judge Furman case is complex,
we agree on that.
There was a problem Rodriguez'
second lawyer - you get two
when facing death penalty -
couldn't be on video
conference, "not enough
lines." So he called in. This
case is US v. Rodriguez,
19-cr-779 (Hellerstein).
