Trail Mix Purveyor To Fresh Direct Many
Defendants Skip SDNY

SDNY COURTHOUSE,
May 13 – A printing company
based in Izmir, Turkey sued a
slew of US based companies for
not paying $250,000. On May 13
it showed up in the U.S.
District Court for the
Southern District of New York,
and Inner City Press was
there.
Most
of the defendants were not.
SDNY Judge Lewis J. Liman
urged that Turkish plaintiff
SESA, Inc. filed a motion to
default in six weeks. While
the named defendants were
Terrafina LLC, FruNut Global
Commodities and others, there
was reference not only to
Mitsubishi but also to
FreshDirect.
FruNut is
"engaged in the manufacture of
healthy foods such as nuts,
trail mixes and dried fruit."
Who knew such healthy things
are manufactured.
Judge
Liman was transparent in the
proceeding, noting how his
rules differ from other
judges' in the District - he
lets the litigants set the
timelines for their motion
papers, and imposes no paper
limits. But if
FruNut never appears, will
anyone hear of it?
The case is SESA,
Inc. v. Terrafina, LLC et al.,
20-cv-1265 (Liman).
