SDNY COURTHOUSE,
Sept 10 –
Joshua Rosner sued the IRS in
2016 for not extending the
three year statute of
limitations to file for a
refund due to his "financial
disability" -- PTSD.
He redacted much
of his complaint but his
request to seal was
subsequently
denied.
On September 13 U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl held a
proceeding. Inner City Press
covered it.
Rosner said
he'd gone through a very
difficult period of time, and
that the government would not
move, despite Magistrate Judge
James L. Cott's efforts
earlier in the case.
Judge Koeltl
said, as he does, that he does
not get involved in
settlement, so that he can
rule on motions and preside
over trial. He said motions
for summary judgment are due
October 29.
The case is
Rosner v. United States of
America, 16-cv-7256 (Koeltl /
Cott)
