SDNY COURTHOUSE,
August 30 – The NYC Department
of Education was sued under
IDEA by J.M., the mother of
D.M. who has autism and "has
also been diagnosed with mood
disorders and self-abusive
behaviors." D.M. was placed in
the only NPS Program on Staten
Island -bu which has no
after-school programs.
On August
29, 2022 U.S. District Court
for the Southern District of
New York Judge Paul A.
Engelmayer held a proceeding.
Inner City Press covered
it.
The parties'
status letter said Defendants
recent provided a
comprehensive offer... but
Plaintiffs need additional
time to review the offer and
calculations.
Judge
Engelmayer urged the parties
to work it out.
He extended
the discovery deadline but
said that unless a giant
meteor hits Earth, the
deadline will not be extended
- even a small meteor will not
do it. Counsel said they
understood.
The case is J.M.
et al v. New York City
Department of Education et
al., 20-cv-1329
(Engelmayer)
