SDNY COURTHOUSE,
June 8 –
Juan Torres and others sued
Ethos Gallery 51 and the
Pathos Cafe for failure to pay
minimum wage and
overtime. Then it seemed
a settlement was
reached.
On November 30, 2021 U.S.
District Court for the
Southern District of New York
Judge Gregory H. Woods held a
proceeding. Inner City Press
covered it.
The
settlement was put forward in
2020. But on October 26, 2021
Plaintiffs' counsel asked
Judge Woods to enforcement the
settlement. And so the
November 30 proceeding was
held.
At
it, Judge Woods declined to go
directly to enforcement.
Instead, he
directed the parties to meet
and confer and submit a joint
letter on the appropriate
structure to litigate the
issues, including whether a
new or additional complaint
should be filed.
Jump cut to June
8, 2022, when Judge Woods
convened another conference.
This time, he gave the parties
until June 22 for a status
letter on the status of their
negotiations for resolving
their dispute regarding the
settlement agreement.
The case is
Torres et al v. Ethos Gallery
51 LLC et al., 17-cv-2064
(Woods)
