SDNY COURTHOUSE,
May 25– Manuel Gervacio
Angeles worked as a cook in
180 Express Deli at 906 East
180th Street in The Bronx. But
he was not paid overtime. He
sued.
On
September 22, 2020 U.S.
District Court for the
Southern District of New York
Judge Mary Kay Vyskocil held a
proceeding. Inner City Press
covered it.
Judge Vyskocil
expressed skepticism why the
parties needed four months for
discovery.
She also asked if
and why they would need
experts.
On May 25,
Judge Vyskocil held another
conference, and Inner City
Press again covered it. She
admonished one counsel for
waiting too long to ask for
additional discovery, but
extended the time to July 9
for both sides. She referred
the case to Magistrate Judge
James L. Cott to try
settlement. One individual
defendant, Ali Mohammed, is
now pro se. The next
conference in set for July 27.
The case is
Gervacio Angeles et al v. 180
Express Deli Corp. et al.,
19-cv-8809 (Vyskocil)
