Bronxite David Crosby Sought Freedom Before SDNY Judge Pauley and Got It After 126 Months

SDNY COURTHOUSE, May 13 – David Crosby, sentenced to 166 months for a narcotics conspiracy, on May 13 sought release before U.S. District Court for the Southern District of New York Judge William H. Pauley III.

 He was represented by Dawn Cardi, who says he has asthma, and so does not take flu vaccine, as it's "counter-indicated." Inner City Press was there.  

 Cardi says the MCC is being inspected today, that the MCC is not following CDC recommendations. Crosby has told her about vermin in 11 South are terrible. "Yesterday they gave out more masks, had inmates washing down area, a lick and a promise.. I want to address BOP's pro forma, phone it in response to the request for compassionate release."

   Judge Pauley introjected,  Ms Cardi, let me ask you. How long has he been at MCC?

   Ms. Cardi said, He was in transit to a halfway house when COVID hit. She asked her colleague Chad Edgar about the Melrose Houses in The Bronx. He said he does not have the information.  Next the Assistant US Attorney defended the Bureau of Prisons' provision of health care. He said, As to the MCC, that the US filed a letter in the EDNY describing its good works on COVID-19 at the MCC. He said the BOP's website reports zero current inmate infections at MCC. "The US requests motion be denied." 

   Dawn Cardi replied, We have to consider what we are talking about for a man like Mr Crosby to get this disease - don't be fooled that COVID is gone but it is not - he will not make it if he gets the disease. 86% of those put on ventilators never get off. Send him home. 

   Judge Pauley ruled, I find that the defendant has shown compelling reasons under the [AG's] Policy Statement. He suffers from history of asthma and had his spleen removed. He has accumulated the maximum amount of good time. He's served 126 months.... His crimes was serious, and I gave him a lengthy sentence. He'll now be released when he completes his quarantined. Then he'll be fitted with a location monitor. 

 Dawn Cardi asked who will tell her client, she only communicates with him through these calls. "So that the records is clear, he has not been quarantined."    Judge Pauley said, Then he'll be released in short order. To go and self-quarantine. I'll include that in my order.  

 Probation's Ed Johnson suggested home incarceration be reduced to six months.

  Judge Pauley agreed, saying Thank you, I will include that. This matter is concluded. Please stay safe. The case is US v. Crosby, 09-cr-1056 (Pauley).
