SDNY COURTHOUSE,
July 2 – Jonathan
Corbett is a
California-licensed lawyer
with a residence in New York.
He sued the Cuomo
administrations quarantine
order, saying he wanted to
return to New York from Nevada
and California.
On July 2 U.S.
District Court for the
Southern District of New York
Judge Lorna G. Schofield held
a proceeding on Corbett's
requested restraining order.
Inner City Press covered
it.
Governor
Cuomo's lawyer mocked Corbett
as "not a scientist."
But an amici, or
wanna-be amici, also spoke up.
He said his son was set to fly
to New York from Florida but
would not if it meant he could
not go to Central Park, while
took out at
it.
Judge Schofield
listened but ruled no. She
said, There are well meaning
concerns expressed here,
but... The balance of interest
lies with the government. And,
petitioner does not meet
likelihood of success. Yes,
right to travel is implicated.
Still, in these extraordinary
circumstances, this 1905 case
[Jacobson v. Massachusetts,
197 U.S. 11, 31] is important.
The Deputy Commissioner shows
it. And while some of the idea
are interesting [testing
instead of quarantine] they
are not in evidence so I am
relying on the Deputy
Commissioner's material, which
is in the evidence. TRO
denied. We are adjourned.
