SDNY COURTHOUSE,
Oct 20 – The U.S. Securities
and Exchange Commission sued
Lee Simmons for "a scheme to
defraud the market with a
fraudulent tender offer for
BlueLinx Holdings Inc. using
Bluefin Acquisition LCC which
he formed in late
2019.
On October
19, 2022, U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held a proceeding. Inner City
Press covered it.
Simmons is representing
himself: pro se.
Depositions are
now due by February 10, 2023,
with an oral argument set for
March 17, as a final
conference before a requested
jury trial.
