In another in the series of
website inaccessibility cases
by blind plaintiffs, Arturo
Estevez has sued Kala Health
Enrichment, Inc. and its
website under the Americans
with Disabilities
Act.
On January 3, U.S. District
Court for the Southern
District of New York
Judge Gregory H. Woods held a
proceeding. Inner City Press
covered it.
Defense
counsel said there is more and
more caselaw that the websites
are not public accomodations
under the ADA, and asked to be
allowed to move to dismiss.
Judge Woods granted
permission, saying that the
motion to dismiss is due by
January 24, with the response
due three weeks afterward and
a reply, if any, two weeks
after that.
