SDNY COURTHOUSE,
Oct 22 – Jennifer Boerke was
injured in a bathroom stall on
the third floor of 25 Broadway
on June 18, 2019. Now two
insurers are litigating about
it. Travelers'
Phoenix Insurance Company has
sued Allied World Assurance
Company seeking a declaration
it is obligated to defend and
indemnify.
On October
19, 2022, U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held a proceeding. Inner City
Press covered it.
Judge
Rakoff said depositions are
due by January 17, 2023, with
a final pre-trial conference
to be held on March 16 at 11
am.
The case is The
Phoenix Insurance Company v.
Allied World Assurance
Company, Inc., 22-cv-6134
(Rakoff)
