Man Arrested
For Drugs in Apartment of Mother in
Yonkers Haltingly Pleads Guilty in SDNY

SDNY COURTHOUSE,
Feb 3 – Cesar
Fernandez-Rodriguez was
arrested in connection with a
heroin mill apartment in
Yonkers, New York in December
2019.
On February
3, U.S. District Court for the
Southern District of New York
Judge George B. Danials held a
change of plea proceeding.
Inner City Press covered
it.
Fernandez-Rodriguez
said he had not been able to
meet with this able counsel,
due to COVID lockdowns.
He allocuted to
50 grams of heroin; the AUSA
said it should be 100 and so
it was. Sentencing was set for
April 16.
Then on
February 17 in the same case,
Rolopho Diaz came to pled
guilty. But it did not go
smoothly.
Dias
repeatedly said what he did
was agree to hold an unknown
quantity of drugs in his
mother's apartment. He said, I
just want this to be over.
Judge
Daniels said that was not
sufficient, wanting things to
be over. Inner City Press live

Now before SDNY
Judge Daniels, a man is trying
for the second time to get a
guilty plea to narcotics
distribution accepted.
He says, My
lawyer tells me that by
passing on the package from my
mother's house, I distributed.
Judge Daniels: This is not
rocket science
Judge
Daniels: Tell me what you
agreed to do?
Defendant:
They were supposed to pick up
the package. They didn't, but
they were supposed to. Judge
Daniels: You didn't know the
amount of drugs?
Defendant: They
said it was four kilos. But I
didn't know.
Judge Daniels:
How did you end up with drugs
in your house? What did you
agree to do?
Defendant: The
guy told me he would put the
drugs in my mother's house.
Judge Daniels: I know what he
did - what did YOU do? I'm not
hear to pull teeth, or talk
you into anything
Defendant: I
agreed to give it to whoever
came to pick it up. But they
never came.... Judge
Daniels: So how do you
plead? Defendant: Guilty.
Diaz' sentencing
is set for June 9.
