SDNY COURTHOUSE,
April 20 – The union Buildings
Services 32BJ Suppemental
Retirement and Savings Plan
filed an ERISA lawsuit against
The Burks Companies, Inc. more
than year ago.
But in a
proceeding covered by Inner
City Press on April 20, 2020
Burks' lawyer said that
because her clients' business
is cleaning casinos and they
are all closed by Coronavirus,
it is hard to get records.
U.S.
District Court for the
Southern District of New York
Judge Jesse M. Furman did not
agree, noting that the
underlying tax records should
be able to be obtained. He
allowed discovery to go
forward, with the prospect of
sanctions looming.
The case is
Buildings Services 32BJ
Suppemental Retirement and
Savings Plan, et al., v. The
Burks Companies, Inc.,
19-cr-2489 (Furman).
