Latvia Cyber Attack Cited To

SDNY COURTHOUSE,
May 19 – On mere hours' notice
on May 21 there was a
Temporary Restraining Order
hearing about "Biogas Latvia"
and a Wisconsin renewable
pellet plant before U.S.
District Court for the
Southern District of New York
Judge Lewis J. Liman. Inner
City Press covered
it.
The
complaint said, "This is a
case about corporate
betrayal... a saboteur who
stole millions of
dollars."
Plaintiffs' counsel spoke
first, saying he wanted
defendant's access to file cut
off, and wanted access to the
Convergen Latvia account to
"put an end to the cyber
attack."
He said there are
defendants in Spain who
are contesting jurisdiction.
He thanked Judge Liman for
holding a hearing at 4 pm on
something filed just this
morning.
The defense said,
There is no urgency, we
dispute they own this data.
Judge Liman
asked, What assures me that
the domain you list won't be
over-inclusive or include a
trade secret?
A plaintiffs'
lawyer replied, That's a good
question. All we want is the
Office 365 account - there is
no reason to intermingle
Latvia with the Wisconsin
pellet plant.
But Judge Liman
crafted an order to more or
less maintain the status quo,
pending another hearing in two
weeks - or longer if the
parties confer and all want
more time to brief it.
The case is
Convergen Energy LLC et al.,
v. Brooks, et al., 20-cv-3746
(Liman).
