SDNY COURTHOUSE,
April 27 – Reginald Latimore,
44 with asthma, sought release
from federal imprisonment due
to COVID-19 in an April 27
proceeding covered by Inner
City Press.
His lawyer
said he could live in
Brooklyn.
U.S. District
Court for the Southern
District of New York Chief
Judge McMahon, ruled, I am
going to leave Mr. Latimore
where he is. He sold one kilo
of cocaine a week. He also
sold fentanyl. On February 24
law enforcement found a loaded
.22 & another eight kilos
of fentanyl. This is not the
defendant's first rodeo. He is
now 44. He has not been scared
straight... I would never
allow this defendant to be
released in a presumption
case, it has most emphatically
not been rebutted. He's
looking at 16 years at the low
end.
She
said, The question is whether
I should release this 44 year
old with asthma due to
COVID-19. The answer is no.
The pandemic has been going on
for two months. The MCC has
had five inmates test
positive. I know of no recent
positive test. HE would be no
safer out than in. The motion
is denied. Anything else?
