SDNY COURTHOUSE,
Oct 18 – An insurance lawsuit
is moving toward trial - but
one witness, citing family
issues, asked not to have to
come to New York to face cross
examination.
On
October 18 U.S. District Court
for the Southern District of
New York Judge Lewis J. Liman
held a proceeding. Inner City
Press covered it.
The
plaintiff Berkley Custom
Insurance Managers said its
witnesses Mr. Ronzella cannot
travel.
On October 18
Ronzello explained the care he
provides to his wife, stating
he is uncomfortable allowing
into their home a home health
worker, even if vaccinated.
Judge
Liman, after asking about the
specifics of Louisiana bridges
and airports, said he cannot
move the trial and will not
waive defendants' right to
in-person cross examination.
He
encouraged the parties to try,
however, to arrange for
Ronzello to be able to fly in
and out on the same day, even
if that means breaking into
testimony or switching the
order of witnesses.
