SDNY COURTHOUSE,
Nov 18 – Miguel Nivar
was presented on a sealed
charge of "felon in
possession" of a firearm or
ammunition on November 18
before Magistrate Judge Sarah
Netburn of the U.S.
District Court for the
Southern District of New York.
While the
U.S. Attorney's Office had
consented to release that very
night on a $25,000 bond, Judge
Netburn cited a policy of
Pre-Trial Services that no one
would be released until a home
visit was conducted by the
Service. (Minutes later a
defendant named Lin, a Chinese
national charged with money
laundering, was released
without any home visit).
Perhaps it
was because the government,
while purportedly offering
same-night release, also
wanted GPS monitoring. But it
remained murky: Lin had no
docket number, and Nivar's
case even hours later remained
"under seal" on PACER. Inner

The case is
US v. Nivar,
19-mj-10179 (Netburn).
