SDNY COURTHOUSE,
April 21 – Nurses have
sued The Bronx' Montefiore
Medical Center amid the
COVID-19 pandemic in order to
get N95 masks, to make the
hospital comply with staffing
ratios with respect to
ventilators, enforce the
visitor policy and ensure
Coronavirus testing of RNs on
demand, including antibody
testing.
In a court
hearing apparently only
covered by Inner City Press,
the NYS Nurses Association on
April 21 asked for a temporary
restraining order before U.S.
District Court for the
Southern District of New York
Judge Jesse M.
Furman.
Montefiore, represented by
Proskauer Rose, opposed the
relief that is being
requested.
Instead
they are proposing a mediator,
other than the assigned SDNY
assigned Magistrate Judge
Katharine H. Parker who they
allude might have a conflict
of interest.
Judge
Furman said he would contact
her to determine her policy,
but that he awaited the
parties either agreeing to a
mediator by 10 am on April 22
or submitted simultaneous
letter proposing how to move
forward. (This differs from
some other SDNY judges who
emphasize that their
individual rules require joint
letters).
In this
case, things must move fast.
