SDNY COURTHOUSE,
May 29 – Christian
Guerrero-Melgares was applying
for release on bail amid
COVID-19 before U.S. District
Court for the Southern
District of New York Judge
William H. Pauley III, who
asked if he every complained
about asthma before March
2020. Inner City Press covered
the proceeding.
Judge Pauley said to the
defense lawyer, He has some
history of asthma but it
seems, to me, sketchy. He only
reported it March 26, when it
was reported that the CARES
Act was coming and relief
would be possible. The day
before the Act was signed by
the President, your client
complained.
Judge Pauley asked, Is asthma
alone sufficient to overcome
the presumption?
The
defense lawyer answered,
Asthma and COVID-19. There are
cases here in the Second
Circuit. I am asking that you
release him to his mother's
home in Virginia.
Judge
Pauley said, After reviewing
the parties' submission
including medical records,
this court denies the
defendant's application.
The case is
US v. Romero, 19-cr-734
(Pauley).
