SDNY COURTHOUSE,
May 19 – Daniel Martinez, in
the Westchester County Jail,
was up for sentencing on May
19 before U.S. District Court
for the Southern District of
New York Judge Analisa Torres.
Inner City Press covered
it.
His lawyer
John Diaz said he's been using
meth for the last 10 years.
"The US focused a lot on 60
pounds" of meth, he said. It
was the cooperative witness
who asked for that weight. Mr.
Martinez stated this in the
Safety Valve proffer. Why
spend $38,000 a year to keep
him a prison? I am asking for
a sentence of 10 months then
treatment.
Assistant US Attorney Nicholas
Chiuchiolo said, Only the last
18 pounds were purchased by an
agent of the government. And
Mr. Martinez said, I can get
that for you, my boy. There no
factual dispute.
Judge Torres said, The
guidelines are 135 to 168
months... But I am imposing 41
months, and the RDAP Program,
and two years of Supervised
Release.
The case is US v.
Martinez, 19-cr-728
(Torres).
