SDNY COURTHOUSE,
May 29– Yessenia Rodriguez
pled guilty in 2006 but
apparently had bad advice,
which did not inform her of
the immigration consequences
of the plea.
Now she is
seeking to withdraw her guilty
plea. But the previous lawyer
cannot be found, and his son
says he does not remember the
case.
On May 29
U.S. District Court for the
Southern District of New York
Judge Gregory H. Woods held a
conference on the case. Inner
City Press covered
it.
Assistant US
Attorney Elizabeth A. Espinosa
and Rodriguez' assigned
Federal Defender both
described their efforts to
find the previous lawyer.
Judge Woods gave
them another month, then said
he is prepared to move
forward. The case is US v.
Rodriguez, 01-cr-00977
(Woods).
