SDNY COURTHOUSE,
Nov 26 – On June 30 at 2 am in
front of 1475 Townsend Avenue
in The Bronx, Johnny Nunez was
approached by police and
dropped something on the
ground. He said it was a box
cutter; the police and FBI
Special Agent Michael Ercolano
say it was a gun, specifically
a .38 Special caliber
Derringer pistol.
On
November 26 U.S. District
Court for the Southern
District of New York
Magistrate Judge Robert W.
Lehrburger asked Nunez's
assigned CJA lawyer Inga
Parson is she would argue to
get Nunez released on bond.
No,
she said, given the state
issues they would consent to
detention without prejudice to
making a bond motion later.
Assistant US Attorney Frank
Balsamello, who earlier on
November 26 argued for and got
a 35 year sentence against
Edwin Romero in another Bronx
case, waited in the
Magistrates Court to go back
before Judge Lehrburger and
push the preliminary hearing
from December 10 to December
30. The case is US v.
Nunez, 19-mj-6577
(Lehrburger).
