SDNY COURTHOUSE,
Feb 4 – In what was the first
criminal case of 2020 in the
U.S. District Court for the
Southern District of New York,
20-cr-001, Victor Marmolejo
a/k/a "Andy" and Frank Medina
a/k/a "Flaco" were indicted on
January 2 for heroin, cocaine,
and methamphetamine, its
salts, isomer and salts of
isomers.
On January
27 in front of assigned Judge
Jed S. Rakoff, the two are
arraigned on a superseding
indictment for only heroin and
crack cocaine. Both pled not
guilty, but remain in
detention.
It appeared,
however, that they would be
offered a speedy trial. Judge
Rakoff set the next date for
March 4, and said he would set
a trial date at that time.
Inner City Press wrote that it
would continue to follow the
case. And it has.
On February
3, Judge Rakoff held the
sentencing of Marmolejo.
Medina has already been
sentenced to 48 months, and
Marmolejo has medical
hardships. The government
asked for a below guidelines
sentence. Judge Rakoff agreed,
imposing 18 months, thirteen
and a half of which have
already been served.
The case is US v.
Marmolejo, 20-cr-1 (Rakoff).
