SDNY COURTHOUSE,
May 6 – Mario Garcia has been
in the Metropolitan
Correctional Center for the
last two months amid the
Coronavirus pandemic. How did
he get there?
He came to
the United States from Mexico
in 1999, initially working at
"menial" jobs then as a low
level drug dealer. He was
arrested and
deported.
He returned
on foot, making his way to New
York. He worked as a
dishwasher and busboy but was
arrested for illegal re-entry.
He was sentenced in the EDNY
to 27 months then deported
again.
But his mother in Mexico
became ill and he returned to
the Bronx to try to make money
for her care, working in a
restaurant and making
deliveries. He was arrested
and detained amid the COVID-19
pandemic.
On May 6 he
came up for sentencing before
U.S. District Court for the
Southern District of New York
Chief Judge Colleen McMahon.
Inner City Press covered it.
Assistant US
Attorney Jacob H. Gutwillig
sought a further sentence of
10 to 16 months.
Judge McMahon to
her credit decided on time
served and deportation, adding
to Garcia that he must not
come in again. But she called
his desire to care for his
month honorable. The case is
US v. Garcia, 19-cv-787
(McMahon).
