SDNY COURTHOUSE,
Oct 20 – Alex Aybar was up for
sentencing on October 20,
before U.S. District Court for
the Southern District of New
York Judge J. Paul Oetken.
But there
was no US Attorney's Office
sentencing submission in the
docket, not even redacted. It
simply was not there.
During the
sentencing, which Inner City
Press covered, Assistant US
Attorney Jason Richman
referred to an agreement the
government had with Aybar, and
to having been "disappointed"
by his involvement in another
narcotics group after
that.
Aybar
spoke movingly, about now
being 49 and never returning
to jail.
His lawyer
asked for 24 months, of which
he'd served 21 months.
Judge
Oetken, treating the missing
sentencing submission more
delicately, decided on 33
months, which means another
year in.
The case is US v.
Aybar, 17-cr-527 (Oetken)
