In SDNY Jose Rivera Had Sentence Reduced Now Bailed to Mother's House on Sex Charges

SDNY COURTHOUSE, Nov 27 – It's a common name in The Bronx, Jose Miguel Rivera, but this is not a common story. He was sentenced to 60 months in prison on Federal narcotics charges by U.S. District Court for the Southern District of New York Judge Deborah A. Batts.

   Then his sentenced was reduced to 57 months "based on a guideline sentencing range that has subsequently been lowered and made retroactive by the United States Sentencing Commission."   

He was released, he reported to Probation - then he was arrested on charges of sexual abuse of a minor. On December 10 he appeared in shackles on a Violation of Supervised Released before SDNY Magistrate Judge Sarah L. Cave.    Judge Cave told his lawyer, "We're talking about sexual abuse of a minor."

    Ultimately after a break to consider the situation Judge Cave said he could be released, not to his own home but to the home of his mother.

   In a letter to Judge Batts on April Fool's Day 2012, his mother wrote that he had been a baseball pitcher until during a fire at 945 Saint Nicholas he fell from the third floor and broke his arm. He ended working for a company associated with Verizon, Lisn Inc.

   Sometimes defendant who are provided conditions of release do not leave the same day. But at 7:30 pm, Inner City Press witnessed Jose Miguel Rivera being taken to the courthouse's entrance on Worth Street and let go. He will appear before Judge Batts on January 7. The case is US v. Rivera, 11-cr-651 (Batts / Cave).
