SDNY COURTHOUSE,
March 25 –
Juan Sanchez and George Royer
sued Bank of America, Bayview
Loan Servicing and MERS for
predatory mortgage practices.
The lawsuit was filed in state
court in The Bronx but Bank of
America removed it to Federal
court.
On March
25, U.S. District Court for
the Southern District of New
York Judge LewJohn G. Koeltl
held a proceeding. Inner City
Press covered it.
Plaintiffs
counsel said the case should
be in The Bronx, before a
Bronx jury. Judge Koeltl said
he understood the impulse, but
that if there is diversity,
the case would stay Federal.
He asked the
defendants to demonstrate
their citizenship (outside of
New York).
The case is
