SDNY COURTHOUSE,
Dec 18 –
Juan Pablo Duarte had three
bricks of fentanyl, the
government alleged on December
18, not in his Newark
apartment but rather in his
car.
Since he
has a two and a half year old
son, the Assistant US Attorney
argued that he must be putting
the child at risk if and when
he drove him in the
car.
U.S. District
Court for the Southern
District of New York
Magistrate Judge Kevin N. Fox
didn't buy it. He asked the
AUSA is he had any proof that
the car is a "permanent
storage locker" for
drugs.
Duarte's partner
and the mother of his two and
a half year old had been in
the SDNY Magistrates Court
gallery with Inner City Press
since 11 am.
Judge Fox put
weight on this, and that she
had Duarte's passport in her
purse. She was to turn the
passport in, and Duarte could
be released after signing a
bond.
It was a
presumption case, but Judge
Fox said the presumption was
rebutted. The case is US
v. Duarte, 19-mj-11811
(Fox).
