In SDNY Pakistani Extradited From Nigeria Has US Request For More Time Year After Quiet Presentment

SDNY COURTHOUSE, June 14 – A Pakistani man accused of trying to import heroin into the US and just extradited from Nigeria was arraigned on April 29, 2019 in the U.S. District Court for the Southern District of New York Magistrate's courtroom, presided over for the week by Magistrate Judge Kevin Nathaniel Fox. Inner City Press was present in person and reported on the presentment, which was not otherwise announced.

In the courtroom that day, along with Inner City Press as the only media, were several heavily bearded US agents. This shacked defendant Muhammad Khalid Khan, with the same genial Pashto interpreter as in the a recent SDNY Taliban case covered by Inner City Press, pled not guilty. His Federal Defenders lawyer did not in this proceeding seek bail, and later conferred with the also FD lawyer in the Taliban case.

  Now more than a year later, the US Attorney's Office has asked for more time: "Re: United States v. Muhammad Khalid Khan, 18 Cr. 830 (VSB) Dear Judge Broderick: The Government writes, jointly with defense counsel, to respectfully request that the next pretrial conference, currently scheduled for June 17, 2020, be adjourned for approximately 60 days. With the consent of defense counsel, the Government also moves for the exclusion of time under the Speedy Trial Act, Title 18, United States Code, Section 3161(h)(7)(A), until August 17, 2020 or any alternative pretrial conference date set by the Court. The adjournment and the exclusion of time will permit the parties to continue discussions regarding the potential for a pretrial disposition in this matter. Respectfully submitted, GEOFFREY S.
