In
SDNY Pakistani Extradited From
Nigeria Extended To August
Year After Quiet Presentment
By Matthew
Russell Lee, @SDNYLIVE
SDNY COURTHOUSE,
June 15 – A Pakistani man
accused of trying to import
heroin into the US and just
extradited from Nigeria was
arraigned on April 29, 2019 in
the U.S.
District Court
for the
Southern
District of
New York
Magistrate's
courtroom,
presided over
for the week
by Magistrate
Judge Kevin
Nathaniel Fox.
Inner City
Press was
present in
person and
reported on
the
presentment,
which was not
otherwise
announced.
In
the courtroom
that day,
along with
Inner City
Press as the
only media,
were several
heavily
bearded US
agents. This
shacked
defendant
Muhammad
Khalid Khan,
with the same
genial Pashto
interpreter as
in the a
recent SDNY
Taliban case
covered by
Inner City
Press, pled
not guilty.
His Federal
Defenders
lawyer did not
in this
proceeding
seek bail, and
later
conferred with
the also FD
lawyer in the
Taliban case.
Now more than
a year later,
the US
Attorney's
Office asked
for more time:
"Re: United
States v.
Muhammad
Khalid Khan,
18 Cr. 830
(VSB) Dear
Judge
Broderick: The
Government
writes,
jointly with
defense
counsel, to
respectfully
request that
the next
pretrial
conference,
currently
scheduled for
June 17, 2020,
be adjourned
for
approximately
60 days. With
the consent of
defense
counsel, the
Government
also moves for
the exclusion
of time under
the Speedy
Trial Act,
Title 18,
United States
Code, Section
3161(h)(7)(A),
until August
17, 2020 or
any
alternative
pretrial
conference
date set by
the Court. The
adjournment
and the
exclusion of
time will
permit the
parties to
continue
discussions
regarding the
potential for
a pretrial
disposition in
this matter.
Respectfully
submitted,
GEOFFREY S.
BERMAN United
States
Attorney By:
Rebekah
Donaleski,
Kimberly
Ravener."
And
on June 15,
Judge
Broderick
endorsed it:
"Application
Granted. The
status
conference
scheduled for
June 17, 2020
is hereby
adjourned to
August 21,
2020 at 12:00
p.m. The
adjournment is
necessary to
permit the
parties time
to continue
discussing a
pretrial
disposition of
this matter.
The Court
finds that the
ends of
justice served
by granting a
continuance
outweigh the
best interests
of the public
and the
defendant in a
speedy trial.
Accordingly,
it is further
ordered that
the time
between June
17, 2020 and
August 21,
2020 is hereby
excluded under
the Speedy
Trial Act, 18
U.S.C.
3161(h)(7)(A),
in the
interest of
justice.
(Signed by
Judge Vernon
S. Broderick
on 6/15/20)."
What has been
happening
during this
more than a
year, other
than the
Coronavirus
lockdown?
Inner City
Press will
stay on this
case. It
is US v.
Khan,
18-cr-830
(Broderick).
