SDNY COURTHOUSE,
Feb 18 – Amaurys Hernandez was
charged with the armed robbery
of a drug dealer in The Bronx;
he sought to introduce
evidence of racial bias and
targeting. Assistant US
Attorneys Dominic A. Gentile
and Ni Qian on February 17
filed a motion in limine to
preclude questioning on racial
discrimination. They said
"after several rounds of
discovery... this Court has
found no evidence of racial
discrimination."
On February 18 Amaurys
Hernandex appeared before
Judge Rakoff to plead guilty.
Inner City Press, which covers
the racial disparities case(s)
and issue, was there. There is
(much) more to be said about
this case and issue. But the
guilty plea went smoothly,
with an agreed sentencing
guideline range of 123 to 138
months for a Hobbs Act robbery
in April 2019 in The
Bronx.
The sentencing is set for May
18; Judge Rakoff said that the
defendant must himself answer
the questions for the
pre-sentencing report, through
CJA lawyer Calvin Scholar can
be present. The case is US v.
Hernandez, 19-cr-323
(Rakoff).
