SDNY COURTHOUSE,
Jan 3 – The US v. Ashirova
case has 31 defendants. But on
January 9 in a circus-like
status conference at which
Inner City Press was the only
media, one defendant stood
out.
Nikolay Tupikin
had written to SDNY Judge
George B. Daniels saying he
wanted a new lawyer.
Judge Daniels
told him that if he made the
supervision, that was it,
there would be no third lawyer
no matter what. Tupikin
through an interpreter
indicated Yes - what choice
did he have? To be fair, later
Inner City Press noticed he
and outgoing CJA counsel Ezra
Spilke fist-bumping.
Later on
the January 9 down in the SDNY
Magistrates Court, Kelley
Sharkey was named Tupikin's
second and last lawyer --
without Tupikin being present.
Magistriate Judge Debra
Freeman, who has been working
hard all week, said that if
Tupikin has an objection he
should come to court.
He is, of course,
in detention in the MDC. We'll
have more on this. The overall
case is US v. Ashirova, et
al., 18-cr-509 (Daniels); this
one is US v. Tupikin,
19-cr-509-23 (Daniels).
