Bretas de Freitas Gets Time Served
Sentence In SDNY

SDNY COURTHOUSE,
Feb 29 – When Fabio Bretas de
Freitas came to plead guilty
on August 8 he was supposed to
have a Portuguese interpreter
in the U.S. District Court for
the Southern District of New
York courtroom of Judge Laura
Taylor Swain. But the
interpreter never came, and
the defendant in sometimes
halting English proceeded with
his plea.
With a
plea agreement for 97 to 121
months and a forfeiture of
over $5 million the defendant
was surprisingly upbeat.
Perhaps he has an inkling that
he will serve less time, or be
deported or removed before
serving much more time as
sometimes happens (he is not a
US citizen). The US Attorney's
Office promoted the proceeding
but Inner City Press was the
only media in the courtroom
that day.
On February
25, 2020 Inner City Press went
to the sentencing of Bretas de
Freitas. After lengthy
discussion of his various
medical issues, he was given a
time served sentence --
released: "ORDERED that
pursuant to sentence of time
served imposed today, the
defendant Fabio Bretas De
Freitas is discharged from the
custody of the U.S. Marshals
Service. SO ORDERED. Dated:
New York, New York February
25, 2020 ~LOR SWAIN United
States District Judge." The
case is US v. Bretas De
Freitas, 19-cr-257 (Swain).
