SDNY Cooperator Works Hard But Covid Stimulus Check Is Gone Other Information Confidential

SDNY COURTHOUSE, April 24 –  During this pandemic of COVID-19, even supervised release proceedings provide a window into the the spread of, and reactions to, the novel coronavirus. 

  But only some of what's said, perhaps for good reasons, can be reported.

  On April 23 U.S. District Court for the Southern District of New York Judge Richard M. Berman held a proceeding with supervisee Eugenio Ricardo.

The public docket reflects that while Ricardl pleaded guilty in 2014, that fact was sealed until April 2017: "04/05/2017 -- ORDER as to Eugenio Ricardo accepting guilty plea. (Filed under seal/delayed docketing on 9/24/14). (Signed by Judge Richard M. Berman on 9/24/14)(jm) (Entered: 04/06/2017)."

   Still Ricardo is subject to a restitution order, and the downturn in the economy obviously has an impact on that.

Judge Berman to his credit said that there are other more important issues.  He asked Ricardo if the stimulus check would tide him over. The answer was that it was already gone, to pay bills.  

 These are public facts. 

But as it was announced mid-proceeding that medical information is confidential -- even as many defendants openly discuss their medical information in order to seek release from prison or even terms of supervised release -- Inner City Press out of respect will respect it.

   Could there be a better way to separate medical from other information, to not leave a lack of clarity for journalists as to what they can and cannot or should not report? Yes. We'll have more on this. This case is US v. Ricardo, 13-cr-587 (Berman).
