SDNY COURTHOUSE,
Dec 3 – Wilmer Correa
Yusti was extradited from
Colombia to the United States
earlier this year on a sealed
indictment obtained in June
2017 by then-US Attorney Joon
H. Kim, on charges of
conspiracy to import narcotics
into the US and conspiracy to
distribute narcotics.
On December 3 Correa pled
guilty to both counts before
U.S. District Court for the
Southern District of New York
Judge Alvin K. Hellerstein;
each count carried a ten year
mandatory minimum.
But, it emerged during the
change of plea proceeding,
Correa has obtained from the
Office of US Attorney Geoffrey
S. Berman a cooperation
agreement until which, if he
fully discloses his crimes and
all related information that
he knows, he may receive a
sentence below the stated
mandatory minimum.
Although a date has already
been assigned for the
sentencing - March 20, 2020 at
11 am - Assistant US Attorney
Michael D. Neff after the
proceeding declined, albeit
politely, to provide Inner
City Press with the docket
number. There is a June 21,
2019 protective order signed
between Neff and Correa's
lawyer Harry H.
Rimm.
From the unsealed
indictment and what documents
there are in the docket,
Correa was accused of
assisting a drug mule in
Colombia who would fly back to
the United States having
swallowed dozens of
heroin-filled
balloons.
While the
underlying seizure of drugs
was effectuated in Florida,
Neff said that the destination
was New York, and that Correa
first arrived in the US, under
an extradition order which
spelled his name Wilmer Correa
Yusty, at an airport in
Westchester County in the
SDNY. That is enough, Neff
said, for venue on the Count 1
importation charge.
The status
of Wilmer Correa's
co-defendant Marino Amaya
Duque is not knowable from the
public docket. There is only
the 2017 indictment, and a
sealed document from May 2019.
The case is US v. Correa,
et al., 19-cr-378
(Hellerstein).
