Richard Leibowitz has sued
Buzzfeed but that's not really
the news.
On May 1 Inner
City Press called in to cover
Leibowitz's case on behalf of
photographer Brian Jamie
Beothlisberger before U.S.
District Court for the
Southern District of New York
Judge Denise L. Cote.
There was a
backlog; Judge Cote advised
those on the line that the
Press was on the line so to
treat it as if it were in open
court. (She also made a point
of saying that anyone who
recorded or "rebroadcast" the
proceeding would be subject to
sanctions).
No, beyond
this mundane copyright or
licensing case, the news here
was sad. Buzzfeed's lawyer
Nancy Ann Del Pizzo said that
she had lost her mother, that
very morning, to COVID-19.
One
wondered why she hadn't asked
out of the conference, and
wanted to offer condolences.
But Inner City Press is "not a
participant."
She recounted how her mother
was in an assisted living
facility, adding that she had
considered taking her out on
April 6 but was told that her
mother would be safer in than
out, like prisoners in the MCC
are being told.
Then her mother went to the
hospital on April 21, was even
given plasma near the end, but
died today, May 1.
Richard Liebowitz, who had
been talking about re-opening,
grew silent. As the proceeding
went forward he admitted he
didn't know if his client had
given the photo away for free,
nor how much his client had
charged. Judge
Cote said archly, next time
come to an initial conference
with more information, it
would help.
But life
goes on, and sadly death too.
