SDNY COURTHOUSE,
Dec 3– Damon Dash has been
sued in a dispute about a film
called "The List" or, "Dear
Frank." But he has been
avoiding being deposed, or
questioned under oath, in
person.
Inner City
Press covered and live tweeted
a proceeding on December 3
before U.S. District Court for
the Southern District of New
York Magistrate Judge Robert
W. Lehrburger, here:
Plaintiff is
complaining he canceled
deposition - then appeared on
IGTV and Dame Dash Studio's
"We Vote. We Won. Now What?"
event.
Judge Lehrburger:
Oh, there is a basis for an
in-person deposition.
Dash's lawyer: Los Angeles has
a stay at home order. Judge:
The big picture is, we've had
too much avoidance by Mr. Dash
in terms of his
deposition.
Judge: Would an
in-person deposition be a
health risk to his child?
Plaintiff: Coulda done it
before the child was born.
And he's still
traveling, to Wyoming in
October 2020 with his fiancee.
That's a red herring.
Judge: Let's --
Plaintiff's
lawyer Christopher Lloyd
Brown: I'm not done. They
wanted to do what they wanted
to do, their townhall, on IG
TV. They've traveled in July
2020, during COVID, in
Wyoming.
Defense lawyer:
There's not a single instance
of Mr. Dash traveling since
the baby was born. The IG TV
was from home. LA Mayor issued
the order on December 2.
We could do it in
mid December, remotely Judge:
Deposition could be done with
masks Judge orders that
Damon Dash be deposed.
Dash's lawyer
asks that it be declared
"essential," for purposes of
the Los Angeles lock-down
order. Done. Plaintiff's
lawyer will get his canceled
rent-a-car and hotel room paid
for.
In the
underlying case, Josh Webber
says Dash is attempting to
steal the film from him,
citing among other things
Instagram posts.
The case is
Webber v. Dash, 19-cv-610
(Liman / Lehrburger)
