Vitaly Nilov Arrested For
Exporting Rifle Making Equipment To Russia

SDNY COURTHOUSE,
Dec 3 – A sealed
complaint for "Conspiracy to
Unlawfully Export Rifle-Making
Equipment" against Vitali
Nilov was signed on November
25 by U.S. District Court for
the Southern District of New
York Magistrate Judge Robert
W. Lehburger.
Alvarado
was arrested at 10 am on
December 3 and was brought
before newest SDNY Magistrate
Judge Sarah L. Cave in
shackles at 5:45 pm. (on-duty
Magistrate Judge Barbara
Moses, it was said to Inner
City Press as the only media
then in the Magistrates Court,
had another responsibility;
Judge Cave will be in charge
of the Magistrates Court later
in December).
Nilov was
assigned free Federal Defender
Jennifer Willis but only for
presentment; Ms. Willis said
he has the resources to retain
his own counsel going forward.
Nilov was released on a
$150,000 bond secured by his
residence and the requirement
to "not possess a firearm,
destructive device or other
weapons" - strange, given the
allegations in the now
unsealed Complaint.
In
the underlying Complaint, US
Commerce Department Office of
Export Enforcement Special
Agent Christopher O'Neill
describes a series of
communications about "$22,000
work of rifling buttons, gun
drills, reamers and pull bores
for approximately 28 types and
calibers of firearms."
The
shippping address used was
"Vitaly Nilov c/o totalrace at
a residential address in
Chappaque, New York." Nilov in
emails referred to Iran and
North Korea. He used an
unnamed Freight Forwarder
which used Luftansa Cargo at
JFK Airport and a straw German
company as "Ultimate
Consignee."
An
hour after the presentment, as
which Inner City Press was the
only media present, the
complaint was still sealed on
PACER. Hours later, Inner City
Press obtained it. The case is
US v. Nilov, 19-mj-11092
(Cave).
