In SDNY Jiminez Cruz Charges
With Drug Importation Nails Down Free Lawyer

SDNY COURTHOUSE,
Oct 10 – Jeremias Jiminez Cruz
was the subject of a sealed
indictment for importing
narcotics signed by Magistrate
Judge Kevin N. Fox of the U.S.
District Court for the
Southern District of New York
in May 2019.
But
it was only on September 7
that Jiminez Cruz was
presented in SDNY Magistrates
Court. That day he was given a
free Federal Defender lawyer,
for presentment only. There
was a doubt whether he could,
in fact, afford to pay for his
own lawyer.
On October 10 with no notice
Jiminez Cruz re-appeared in
SDNY Magistrates Court with
Federal Defender Cohen, this
time before Magistrate Judge
Ona T. Wang. District Judge
Kimba M. Wood had referred the
case down for appointment of
counsel.
Magistrate Judge Wang reviewed
the defendant's financial
affidavit, which is never made
public, and determined he is
eligible for a publicly funded
lawyer. There were three
family members or supporters
in the Mag court gallery,
something on which Judge Wang
usually asks in connection
with guilty pleas but did not
ask on October 10.
It appears
that Jiminez Cruz will now
asked Judge Wood for a bail
hearing. The relation between
being able to afford bail, and
(not) afford a lawyer, remains
murky, as does what happens if
a defendant gets a free lawyer
for presentment and then if
found not to be eligible.
