SDNY COURTHOUSE,
April 22 – Steven J. Mulligan
was fired by Verizon New York
and sued under the American
With Disabilities Act, naming
James Melchione as his main
nemesis.
On April 22 amid
the Coronavirus pandemic U.S.
District Court for the
Southern District of New York
Magistrate Judge Kevin N. Fox
held a conference on the case,
which Inner City Press
covered.
Notably,
the lawyers said that both
Mulligan and Melchione are
currently working as essential
workers which makes, they
said, depositions more
difficult. Melchione no longer
works for Verizon.
The
underlying Complaint said
Mulligan has a severe back
injury which "restricts his
ability to lift items above a
certain weight."
Still, "Melchione
often assigned Plaintiff to
sweep the parking lots when it
was raining."
Judge Fox, like
District Judge Liman earlier
on April 22, urged remote
depositions. The case is
Mulligan v. Verizon, et al.,
17-cv-9390 (Carter /
Fox).
