SDNY COURTHOUSE,
Dec 2 – In the lawsuit of
Virginia Giuffre against Alan
Dershowitz, after a half hour
long discovery conference on
December 2, Inner City Press
asked Dershowitz how long he
and his team wants for their
deposition of Giuffre.
"As
long as it takes," was the
answer. Dershowitz stood in
the hall rattling off
Giuffre's age at differing
points, saying that
Mar-a-Lago's spa is closed in
the summer so that by the Fall
of 2000 Giuffre must have been
17 and a few months, "over the
age of consent in New York."
Two members of his team tried
to urge him toward the
elevator. But Dershowitz
continued, saying Giuffre lied
about Al Gore being on
Epstein's island and that
David Boie's could have called
his client, Gore, and asked.
He cited Secret Service
records that he said show that
an allegation about Bill
Clinton could not be true.

Inside the
courtroom of U.S. District
Court for the Southern
District of New York Judge
Loretta A. Preska, as live-tweeted
by Inner City Press, the back
and forth included:
Judge Preska
started with questions on
alleged sexual trafficking of
Giuffre by Dershowitz, with
Epstein... After the issue of
whether Dershowitz has had sex
with anyone other than his
wife calls outside relevance
standards, Judge Preska added
"Or propriety." She calls
Dershowitz' counter-claim
sweeping and its forthcoming
filings "Massive, no doubt."
Cited: the
discovery in the Giuffre v.
Maxwell case. Note: Ghislaine
Maxwell was given the UN press
briefing room to promote her
business, something Inner City
Press asked the UN about
before being banned from the
UN.
"In
addition to Ms. Giuffre,
another young woman has
claimed she had sex with Mr.
Dershowitz as part of the same
operation." The same
operation?
Judge Preska:
"Lying was part of the
defamation claim... I'm not
sure why you're telling me
this." Using air quotes,
Judge Preska refers to the
"conspiracy to extort
theory." Back to earth:
"We're talking the the scope
of discovery here." Yes.
Dershowitz'
lawyer: "We will need to take
depositions about the truth
defense... And the the
photograph of Prince Andrew,
if we need to determine if it
is a fake or not, we will need
an expert." Judge
Preska: Do not spend any more
on experts until we talk
again.
"Counsel
has mentioned this New York
Times article of yesterday,
which mention
conversations--" "Happy
to produce it. The entirety of
the episode between Mr.
Kessler and the lawyer."
Judge Preska: Does plaintiff
have any recordings? Let's get
going here.
Judge Preska:
This is not going to go on
forever. This is not going to
be the book for my good
friends the reporters to
write. Dershowitz'
lawyer: Sorry to interrupt,
your Honor, but we've been
trying to get previous
testimony about Ms. Giuffre's
travel schedule
Judge Preska:
We're not going to disclose
the transcript publicly
without further discussion. I
think I'd propose that your
initial disclosure including
the dates of travel, so you
can know what we're dealing
with.
Raised: Is
the Maxwell deposition covered
by the protective order? Judge
Preska: What else, friends?
Two weeks? Let me know if you
want to come in and chat. Will
plaintiff be amending?
Yes. We're going to add
additional allegations on
defamation of the same
ilk Judge Preska:
Why do we need to amend to get
in these statements of the
same ilk, other than to get
them out there?
Giuffre's lawyer: Because they
are in a book. They are fresh
defamatory statements.
Dershowitz'
lawyer: We think she was not a
child and so can't avail
herself of the state
statute... Giuffre's
lawyer: We are going to add a
new claim about the
recording. Judge Preska:
Does plaintiff have standing?
I thought it was Mr. Boies who
was recorded.
Judge
Preska: File no motion before
it's time... Question: there's
no additional discovery
triggered by the state court
claims? Delaying discovery is
not wise. What else?
Dershowitz's
lawyer: I don't know how we
could do the deposition of Ms.
Giuffre in one day... We will
serve a subpoena on Mr. Boies,
about the crime-fraud
exception [also came up in #OneCoin trial
Judge Preska: I
would very much like to stay
in contact, the Acela is easy.
What else do you want to do
today? Giuffre's lawyer
introduces 3 colleagues.
And nothing more. It was over,
for the day. [Except for the
hallway stakeout, above.]
The SDNY
case is Giuffre v.
Dershowitz, 19-cv-3377
(Preska).
