SDNY COURTHOUSE,
Dec 18 – When Christopher
Modesto came on an alleged
Violation of Supervised
Release before U.S. District
Court for the Southern
District of New York
Magistrate Judge Kevin N. Fox
on December 18, his Federal
Defender said he had fallen
out of touch with Probation
because he has been "couch
surfing."
Judge Fox asked if it is
possible to have stand-alone
GPS for a defendant without a
fixed home. Federal Defender
Jennifer Willis replied that
she has had clients with just
such a set up, some of them
living in the homeless shelter
on Walds Island and coming to
her office to plug their GPS
into the wall and charge it.
While the
Assistant US Attorney
continued to advocate for
detention, Judge Fox allowed
Modesto to be released after
he signed a $7,500 bond,
ordering him to return to the
SDNY Courthouse on December 19
to figure out the stand-alone
GPS issue or to come before
him again.
Modesto is due before Judge
William E. Smith in the
District of Rhode Island on
December 30 at 10 am. The case
there is US v. Modesto,
17-cr-103 (Smith).
