SDNY COURTHOUSE,
May 14 – The Turkish
restaurant Ali Baba's Terrace,
a block from the United
Nations, harassed its gay
waiter Eyyup Dogan about
attending the LGBT Pride
parade in New York, a
complaint filed against it in
New York State Supreme Court
claimed.
Ali Baba's
Terrace's owner, also named
Dogan (Ali Riza), asked Eyyup
"if he had problems in his
childhood that would have led
him to be 'gentle,'" according
to the complaint.
Ali
Baba removed the complaint to
Federal court, then moved for
a stay of the litigation,
based on the bankruptcy of Ali
Baba's Terrace.
Eyyup
responded that the case should
proceed, including against the
individual
defendant.
Next, Ali Baba's
counsel at Jackson Lewis
informed U.S. District Court
for the Southern District of
New York Judge Paul A.
Engelmayer of the "Order of
Dismissal of the bankruptcy
proceeding involving defendant
Ali Baba's Terrace, dated
October 8, 2019."
So the case
continued. Inner
City Press has been following
this case, including as
Turkish diplomat Volkan Bozkir
appeared as the unopposed
candidate to be President of
the UN General Assembly,
despite his public comments
about "drag queen" Conchita
Wurst winning the Eurovision
award.
There is more to
report about this case, but
given recent developments and
vague language it is unclear
when off the record applies to
conference during the
Coronavirus pandemic, and when
it does not. So we will have
more on this case. It is Dogan
v. Ali Baba's Terrace, Inc. et
al., 19-cv-5715
(Engelmayer).
