SDNY COURTHOUSE,
Jan 7 – Maurice
Patterson was released on his
own signature, represented by
assigned CJA defense lawyer
Rita Glavin, on August 27,
2019. On January 7 he
reappeared in court, agitated
and demanding to speak for
himself to the judge.
His lawyer Rita Glavin, now on
the prosecution side in US v.
Dozinger but still acting as
defense lawyer in US v.
Patterson, was not present in
the U.S. District Court for
the Southern District of New
York Magistrates Court.
The CJA lawyer on duty, Tom
Ambrosio, tried to reach Ms.
Glavin by phone. Meanwhile
Maurice Patterson was crying,
"I'm terrified of prison!"
Magistrate Judge
Debra Freeman to her credit
said she did not want to hear
anything that is not on the
record, and went into her
robing room.
But once there,
Ambrosio and the Assistant US
Attorney went in and spoke,
without the presence of the
defendant or of the Press and
public. Later Judge Freedman
summoned up for a whispered
sidebar conversation the U.S.
Marshall on duty. It was an
extraordinary proceeding.
It appears that Patterson was
sent not back to custody but
instead to a hospital. It
appears that CJA Glavin will
reach out to him. But beyond
the mental health and
culpability issues, how is it
that the same lawyer can be on
the US side of US v.
Donzinger, and on the defense
side in US v. Patterson?
Inner City Press months ago
put the question in in
writing, without answer. It
has been advised to ask the
Federal Defenders. But should
that be necessary? Especially
now? Inner City Press will
stay on this case. It is US v.
Patterson, 10-cr-94 (Rakoff).
