In SDNY Mag Court Reinaldo Roman Pleads To Lesser Included Offense His Names Reversed By BOP

SDNY COURTHOUSE, Oct 21 – Reinaldo Roman was indicted in February in connection with the distribution through Bronx auto body shops of heroin, fentanyl and five kilograms of cocaine. In the Magistrates Court of the U.S. District Court for the Southern District of New York on April 5, he was ordered detained pending trial or disposition, based on the risk of danger to the community.

   On October 21 Reinaldo Roman was due back in the SDNY Magistrates Court to plead guilty to the lesser included charge, with the five kilos of cocaine no longer mentioned. But he was brought in late.

    It turns out that the Bureau of Prison has referenced the first and last names of Reinaldo Roman making his hard to fine. His lawyer told Magistrate Judge Debra Freeman that while he had gone over the plea prior to the delayed proceeding, he had not had the time he usual spent.

   During the allocution at several points Reinaldo Roman asked for questions to be repeated, or said "I'm not following you." Ultimately he said yes and pled guilty to conspiracy to distribute heroin and fentanyl. The government never summarized what evidence it would have shown at trial.

   Judge Kimba M. Wood has yet to sent the sentencing date for Reinaldo Roman, so a control date of January 21 was set. The case is US v. Reinaldo Roman, 19-cr-116 (Wood).
