SDNY COURTHOUSE,
April 23 – Bronx resident
Melissa Avilez went to an
Urban Health Plan facility on
February 29, 2015 but, she
says, failed to refer her to a
breast surgeon.
Bronx
Lebanon Hospital on April 19,
2017 diagnosed Aviles with
"circumscribed rubbery to
slightly firm mass measuring
10 x 7/5 x 7 cm" in her right
breast. Jump cut
to April 23, 2020. Aviles has
sued Urban Health Plan, as a
Federally Deemed Health
Center, for $7 million.
U.S.
District Court for the
Southern District of New York
Magistrate Judge Katharine H.
Parker held a telephone
conference, covered by Inner
City Press. She said the
parties might have to depose
experts remotely, given the
COVID-19 pandemic.
Still she
projected an August 10 trial -
this while District Judge
Vernon S. Broderick in another
April 23 proceeding covered by
Inner City Press said there
may be no jury trials in the
SDNY until 2021. This case is
Aviles v. Santiago, et al.,
18-cv-9270 (Parker).
