SDNY COURTHOUSE,
Nov 27 – Defendant Robert
Lewis appeared in person on
April 1 in a ripped shirt and
a mask against Coronovirus in
Courtroom 23B of the U.S.
District Court for the
Southern District of New York,
seeking to avoid being sent to
the Metropolitan Correctional
Center across the street.
Reflecting the COVID-19
pandemic, his lawyer Louis
Fasulo was not in the
courtroom with Lewis, four US
Marshall, three detectives and
Inner City Press. Assistant US
Attorney Christopher Clore
said he believed that SDNY
Magistrate Judge Robert W.
Lehrburger's deputy had given
Fasulo the number to call in.
By phone, Fasulo argued that
Lewis' diagnosis with M.S.
meant that he should not be
remanded to the MCC.
AUSA Clore
argued that Lewis a violent
gang member who would face as
much danger from COVID-19
outside the MCC as inside.
Fasulo disagreed.
Judge Castel ruled that Lewis
had not overcome the
presumption in the case, and
that given his ties to Antigua
and St. Croix and the long
sentence he faces presents a
risk of flight. Lewis was led
back into the cell block and
from there to the MCC. The
case is US v. Lewis, 20-cr-234
(Preska / Castel).
